Commercial Litigation and Arbitration

The Firm represents parties in a wide variety of business disputes in federal and state courts and a number of arbitral tribunals, providing comprehensive litigation services from case evaluation and pre-litigation negotiation through trial and post-trial proceedings.

Trusts and Estates Litigation

The Firm has advised and represented various parties in New York Surrogate’s Court litigation proceedings including regarding claims of breach of fiduciary duty, challenges to fiduciary accountings, claims against estates and disposition of real property.

Agency Investigations

The Firm advises and represents clients in responding to government requests for documents and testimony in connection with investigations.

International Litigation and Arbitration

The Firm is adept at advising and representing clients from foreign jurisdictions, including civil law jurisdictions, and working with its local country counsel from evaluation of key issues such as jurisdiction through enforcement of and defense against foreign court judgments and arbitral awards with special attention to discovery (information exchange) which is different in the US from other jurisdictions.

Counseling and Compliance

The Firm advises and counsels US and foreign companies regarding laws with which they must comply and which must be considered in establishing a new company such as the US Corporate Transparency Act and other beneficial ownership disclosure laws.

Mediation and Dispute Resolution

Mediation and other alternative dispute resolution (ADR) methods can avoid the time, expense and uncertainty of formal court cases and arbitrations and help preserve business relationships. Often, such ADR processes are required by contracts. The Firm has extensive experience representing parties in such proceedings. Ted Semaya has been appointed to court mediation panels and served as a private mediator. The Firm also assists clients in preparing dispute resolution clauses in contracts that consider all options in litigation, arbitration and ADR.

Advising Foreign Businesses

The Firm advises foreign businesses in various aspects of establishing subsidiaries, affiliates and branches of their operations in the US as to specific legal aspects and in coordination with other professionals and service providers with which it works.
